These Streaming and Content Creator Terms form part of the Terms of Service of Play SC:BW (the "Service"). Capitalised terms have the meaning given there. A plain-language overview is available on the Streaming page; if the overview and these Creator Terms differ, these Creator Terms prevail.
"Creator Content" means any live stream, video, clip, screenshot, broadcast, podcast, article or other content that you make and that shows, includes or is about the Service. "Platform" means any third-party service on which you publish Creator Content, such as live streaming, video and social media services.
1. What we permit
1.1 Subject to your compliance with the Terms, the Operator grants you a personal, limited, revocable, non-exclusive, non-transferable, non-sublicensable, royalty-free permission to capture, stream, record and publish Creator Content that shows the Platform Materials as they appear in ordinary use of the Service, on any Platform, anywhere in the world.
1.2 You may monetise Creator Content through the ordinary features of a Platform, such as advertising revenue share, subscriptions, memberships, donations, tips and sponsorships of your channel, provided that you comply with Section 3.
1.3 No prior approval is needed, and we ask for no fee or revenue share.
2. What we do not and cannot permit
2.1 This permission covers the Operator's own Platform Materials only. Footage of games played through the Service may display or include Third-Party Game Content, such as graphics, sounds, music, voices, names and characters, that belongs to its respective rightful owners and not to the Operator. The Operator does not own, serve or license that content, and grants you no right, licence or permission of any kind in respect of it. Nothing in the Terms, on the Service or in any communication from us is a representation that you are entitled to stream, record, publish or monetise it.
2.2 You are solely responsible for determining whether, and on what conditions, you may include Third-Party Game Content in your Creator Content, for obtaining every permission you need, and for complying with every licence, video policy, content usage guideline and other rule published by the relevant rights holders. Those rules may restrict, among other things, commercial use, paywalled content, sponsorship, organised tournaments and broadcasts, and they may change at any time.
2.3 Music and other audio is frequently subject to separate rights and to automated detection on Platforms. You alone are responsible for any audio in your Creator Content, and for any mute, claim, strike, takedown, demonetisation or suspension that results.
3. Conditions
Your Creator Content and your conduct as a creator must:
- (a) comply with the Terms, including the Acceptable Use and Fair Play Policy, with all applicable laws, and with the terms and community guidelines of every Platform you use;
- (b) not state or imply that you, your channel or your content are affiliated with, sponsored by, endorsed by or official to the Operator, or to any game developer, publisher or rights holder, unless that is true and agreed in writing;
- (c) not use the "Play SC:BW" name or logos as the name or main branding of your channel, product, event or organisation, or in any way likely to confuse. You may use the name in titles and descriptions to say truthfully that your content shows the Service;
- (d) not be hateful, harassing, sexually explicit, defamatory, deceptive or unlawful, and not promote cheating, exploits, account trading, boosting, gambling or any breach of the Terms;
- (e) include every disclosure that law or a Platform requires, including disclosure of sponsorships and paid promotion;
- (f) not sell, license or distribute the Platform Materials themselves, or package footage as a standalone product whose value is the Platform Materials rather than your own creative contribution, such as raw asset rips or unedited captures sold as such;
- (g) respect other people. Other users' handles, gameplay and chat may appear in your Creator Content because they are public features of the Service, but you must not reveal anyone's personal data, target anyone for harassment, or "stream snipe".
Organised, sponsored, ticketed or prize-bearing tournaments and broadcasts that use the Service require our prior written permission, in addition to whatever permission the relevant rights holders require. Write to [email protected].
4. Other players
If you play on the Service, you accept that your games, handle, gameplay and in-game chat may be streamed, recorded and published by other users and by us, anywhere and indefinitely, without notice, consent or compensation. We are not responsible for any Creator Content made by anyone other than us.
5. Your licence to us
You grant the Operator a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, sublicensable licence to link to, embed, feature, excerpt, reproduce, display and share your publicly available Creator Content, together with your channel name and likeness as they appear in it, on the Service and in our community and promotional channels. We have no obligation to feature or credit anyone.
6. Revocation
We may revoke or limit this permission at any time, generally or for any particular person, content or Platform, for any reason or no reason, by changing these Creator Terms or by notice to you. If we ask you to remove or edit Creator Content, you will do so promptly. We may request removal of Creator Content from any Platform where we consider that it breaches the Terms.
7. Your responsibility; no liability on our part
7.1 You alone are responsible and liable for your Creator Content, your channels and everything that results from them. That includes any claim, strike, takedown, demonetisation, suspension, loss of revenue, fine, demand or proceeding by any Platform, rights holder, authority, sponsor, viewer or other third party.
7.2 To the fullest extent permitted by law, the Operator Parties have no liability of any kind in connection with Creator Content, and the disclaimers and limitations in Sections 20 and 21 of the Terms of Service apply in full. We do not guarantee that the Service will be available, stable or suitable for broadcasting at any time, and we are not liable for any interruption to your stream or event.
7.3 Your obligation to defend and indemnify the Operator Parties under Section 22 of the Terms of Service applies to every claim arising out of or relating to your Creator Content, including any claim that it infringes the rights of any rights holder in Third-Party Game Content.
7.4 We will not assist you in any dispute with a Platform or rights holder, and nothing we say or do is legal advice. If you are unsure of your position, take your own advice before you publish.
